Terms of Service

1. Acceptance of Terms

By accessing or using the SendaVid platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. SendaVid is a production of Kiplinger Marketing Group.

2. Description of Service

SendaVid provides a video messaging and hosting platform designed for business communication. Services include video recording, hosting, transcoding (via Cloudflare Stream), and distribution via SMS and email.

3. Accounts and Registration

You must provide accurate and complete information when creating an account. You are solely responsible for the activity that occurs on your account and for keeping your account password secure. You must notify us immediately of any breach of security or unauthorized use of your account.

4. Subscriptions and Billing

• Free Trial: New accounts may receive a limited free trial (e.g., 14 days) or a limited number of free videos.
• Paid Subscriptions: "Pro" and "Platinum" plans are billed on a recurring monthly or annual basis via Stripe.
• Cancellation: You may cancel your subscription at any time via the Settings dashboard. Access continues until the end of the billing period.
• Refunds: Refunds are handled on a case-by-case basis. We generally do not offer refunds for partial months.

5. User Content

You retain ownership of the videos you upload ("User Content"). However, by uploading, you grant SendaVid a worldwide, non-exclusive, royalty-free license to use, reproduce, process, adapt, publish, transmit, host, and display your User Content solely for the purpose of providing the Service (e.g., transcoding for playback).

Liability: You are solely responsible for your User Content and the consequences of posting it. SendaVid does not endorse any User Content or any opinion expressed therein.

6. Acceptable Use Policy

You agree not to use the Service to upload or distribute content that is:

• Illegal, infringing, or fraudulent.
• Defamatory, obscene, pornographic, or harassing.
• Designed to spread malware or viruses.
• Intended to spam or solicit users deceptively.

SendaVid reserves the right to terminate accounts that violate this policy without notice.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability

In no event shall SendaVid, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
